     Full Idea: Dickie's institutional theory of art says that something is a work of art if and only if it has had that status conferred on it by a competent member of the artworld.

     A reaction: The idea that a single 'competent' person can do this sounds daft, and probably circular. A consensus in the artworld sounds more plausible, but this still leaves the revolutionary genius, who - in retrospect - produced unrecognised 'art'.

     Full Idea: Democratic politics is a competition among self-interested politicians, constituting a ruling class, for the support of the people, also assumed to be self-interested, and none too interested or well informed about politics.

     A reaction: This articulates the 'competitive' view of democracy, as simply a technique for establishing legitimacy. Posner is also an economist, and they also assume that everyone is wholly self-interested, which may be why they are so frequently wrong.

     Full Idea: The 'Eumenides' of Aeschylus tells how the old rule of revenge and blood feud was replaced by a due process of law before a civil jury.

     A reaction: Compare Idea 1659, where this revolution is attributed to Protagoras (a little later than Aeschylus). I take the rule of law and of society to be above all the rule of reason, because the aim is calm objectivity instead of emotion.
